Terms of Service
SENTINEL by ST NUBIAN · Last updated 2 September 2026
1. Parties and agreement structure
These Terms of Service cover the use of this website and the Sentinel platform. Use of Sentinel by an agency is governed by a signed subscription agreement and a POPIA operator agreement, which take precedence over this page wherever they differ.
2. What the subscription includes
Dialler connection, rubric encoding, a calibration run against your reviewers, training, support, and storage within the agreed retention window, as set out in the subscription agreement. The service processes the recordings the agency makes available, produces transcriptions and compliance findings, and provides the review workspace and queue described on this site.
3. The agency’s obligations
The agency remains the responsible party under POPIA. It is the agency’s obligation to have lawful grounds to record calls and process the personal information in them, to hold any consents or notifications required, and to ensure lawful grounds exist for the processing Sentinel performs on its instructions.
4. Ownership
The agency owns its recordings and its data. Findings, transcriptions and analytics produced from them belong to the agency. The platform, its models and its rubric engine belong to us; nothing in the service transfers those.
5. Human review
Sentinel is a decision-support system. Findings are proposals for human review; the agency is responsible for the compliance decisions it makes on the basis of them, and for its agents’ conduct. The service does not replace the agency’s compliance function or its legal obligations to regulators.
6. Availability and support
Target availability and support hours are stated in the subscription agreement. We will maintain the platform with reasonable skill and care, keep it available as agreed, and notify the agency of planned maintenance.
7. Warranty and liability
We provide the service as described, but transcription and scoring are inherently imperfect — accuracy is measured and published against the agency’s own reviewers, not guaranteed to be error-free. Liability is capped as set out in the subscription agreement; neither party excludes liability that cannot be excluded under South African law.
8. Term and termination
The subscription runs for the term agreed, typically twelve months. On termination, the agency’s data is returned or destroyed as set out in the operator agreement, with a certificate of destruction issued.
9. Governing law
These terms and the agreements they summarise are governed by the law of the Republic of South Africa. Disputes are subject to the jurisdiction of the South African courts, after a reasonable attempt at negotiation.
